Catch153
Terms of service
Last updated
These terms govern your use of this website and any order you place with Catch153. By placing an order, you agree to be bound by them. We encourage you to read them in full, and in particular the sections on delivery areas and frozen food, which differ from those of a typical online retailer.
About us
Catch153 sells frozen and pre-packed food and groceries online for delivery within Ontario. In these terms, “Catch153”, “we”, “us” and “our” refer to Catch153, and “you” and “your” refer to the person placing the order. You can contact us at orders@catch153.ca.
Your account
An account is required to place an order. You are responsible for ensuring that the information you provide is accurate and kept up to date; an incorrect phone number or address is the most common cause of a failed delivery. You must keep your sign-in credentials confidential, and you are responsible for all orders placed through your account.
We may suspend or close any account that is used fraudulently or abusively, or in a manner that places our staff or delivery drivers at risk.
Delivery areas
We deliver only to designated service areas, identified by the first three characters of your postal code. We are unable to accept orders for delivery outside these areas, and the checkout will notify you before any payment is taken.
Our service areas may change over time, and a postal code we cannot serve today may become serviceable in the future. Delivery charges and free-delivery thresholds may vary by area; the amounts shown at checkout are those that apply to your order.
Orders
Placing items in your basket and submitting payment constitutes an offer to purchase. A binding contract is formed only when we confirm your order, not when your basket is submitted, and we may decline an order at any time before confirmation.
We may cancel a confirmed order and issue a full refund if:
- an item is out of stock;
- the delivery address is found to be outside our service area;
- a price or product description contains an obvious error; or
- we suspect fraudulent activity.
Prices, taxes and delivery charges
All prices are in Canadian dollars. Most grocery items are zero-rated for HST, so tax may apply to only part of your order. Any tax charged is itemised at checkout and on your order.
Delivery is free on orders above the threshold shown at checkout; a delivery charge applies to orders below it. All totals are calculated at the time you place your order, and the delivery charge and threshold applied are recorded on the order. Any subsequent change to our pricing will not affect an order you have already placed.
Prices are subject to change at any time before you place an order. Promotions are valid for the period stated and may be withdrawn.
Payment
Payment is made at checkout using any of the payment methods offered there. Your order is placed once payment has been successfully completed. Card payments are processed securely by Stripe; we do not see or store your card details. For more information, please see our privacy policy.
Delivery
We will notify you when your order is on its way. Delivery times are estimates and are not guaranteed, as weather, traffic and road conditions may affect delivery.
As our products are frozen and chilled, someone must be available to receive the delivery. If no one is available and there is no safe place to leave the order, we may need to return it, and we are unable to offer a refund for goods that thaw as a result. Saving delivery instructions with your address helps us avoid this.
Returns, cancellations and refunds
For food-safety reasons, we cannot accept returns of frozen, chilled or perishable food once it has been delivered, as these items cannot be resold. Change-of-mind returns are therefore not available for these items.
This does not affect your rights where there is a genuine problem with your order. If an item arrives:
- damaged, spoiled or thawed;
- past its date; or
- missing from your order, or different from what you ordered,
please notify us at orders@catch153.ca within 24 hours of delivery, including a photograph of the affected item where possible. Every claim is reviewed by our team, and Catch153 will determine, at its discretion, whether a replacement or a refund is appropriate.
Cancellation requests. You may request the cancellation of an order at any time before it is dispatched. If the cancellation is approved, the full order amount will be issued as store credit to your Catch153 wallet.
Refund method. Where a refund results from an error on our part — for example, an order we cancel because an item is unavailable — it will be issued to your original payment method. All other refunds, including those for customer-requested cancellations, are issued as store credit to your Catch153 wallet. Refunds are normally processed within a few business days.
Store credit. Credit held in your Catch153 wallet may be applied to any future order. It has no cash value and cannot be withdrawn or redeemed for cash.
Product information and allergens
We make every effort to describe our products accurately. However, product images are for illustration only, and pack weights are approximate; products sold by weight may vary slightly.
Please always read the packaging. The ingredients, allergen information and storage instructions on the product you receive take precedence over the information on this website, as manufacturers may change their recipes before we are able to update our listings. If you have a food allergy, please do not rely on this website alone.
Frozen items should be stored at −18 °C or colder and placed in a freezer promptly after delivery.
Use of this website
You agree to use this website lawfully. You must not attempt to gain unauthorised access to it, disrupt its operation, extract its content in bulk, or use it to place fraudulent orders. All content on this website, including text, photographs, and the Catch153 name and logo, is owned by us and may not be reproduced without our permission.
Availability
While we aim to keep our store available at all times, we cannot guarantee uninterrupted access. We may suspend the service for maintenance, and we may change or withdraw products at any time.
Limitation of liability
If we fail to comply with these terms, we are responsible for any loss you suffer that is a foreseeable result of that failure. We are not responsible for any loss that was not foreseeable, or for any business losses.
Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, including liability for death or personal injury caused by our negligence, or affects your rights under Ontario's consumer protection legislation.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts of Ontario have jurisdiction over any dispute arising from them.
Changes to these terms
We may update these terms from time to time. Your order is governed by the version in effect at the time you placed it. The date at the top of this page shows when these terms were last updated.
